These General Purchase Terms and Conditions are applicable to the online sale of all Purificación García products made through the web site www.purificaciongarcia.com (hereinafter “website”) or through the Customer Service (hereinafter “CS”).
In ordering via our website, you hereby warrant that you are over 18 years of age and that you have the legal capacity to make binding contracts.
Orders can only be made to purchase goods without any intention of reselling. Any resale or distribution of products purchased through the web site is strictly forbidden.
We reserve the right to cancel fraudulent, false or speculative orders as well as orders requested by customers with whom any dispute/controversy could exist about previous orders, or when there is a reasonable doubt as to whether the customer is violating any purchasing condition herein contained or participating in any criminal activity.

1.1. Users obligations Users are obliged to provide Purificación García with all information needed for the access and use of the services in this web site. This information must be true and up to date. You also agree as a user that we can use that information to contact you if necessary.
It is essential that you provide all the required information so that we can process your order. We are never responsible for delays or failures in delivering due to omissions or errors in the information that you provided.
Users must make appropriate use of the services listed on the web site, under the terms set out in the law, and bind not to take part in any activity that impedes or interferes in the functioning of those services.
1.2. Security measures We will establish all reasonable mechanisms within our reach to guarantee your personal data shall be kept safe in every moment. However, you agree that no data transmission over the Internet can be guaranteed to be 100% secure against access by unauthorized recipients and that we are not responsible for any security breaches except in the case of our negligence.

Orders can only be made using the web site.
2.1. Online shopping process Through the website, you can navigate until you find the desired item. Once you have found it you will be able to look up all the product information by clicking on it. You can also add the item to your shopping basket.
If this is the first time you have placed an order with us, you will be asked to register by entering your email address and a password with which you can create (and access) your account.
If you are already a registered user and have an account to login, you may enter your email and password and the system will recognize your information.
Once you have logged in you can continue shopping and finally process the order.
2.2. Area covered by offer The zone of delivery of these items is restricted to Spain Poland (Canary Islands, Balearic Islands, Ceuta and Melilla included), Portugal, United Kingdom, Ireland, France, Germany, Luxemburg, Holland and Belgium. By accepting the order, you confirm that you are a resident of any of these zones. Any other delivery address will automatically cancel your order.
2.3. Availability All of our items are subject to availability of stock. We accept no responsibility for the lack of availability or if an item is out of stock.
Please see the selection of items available for sale through the website, since not every product offered in our stores or shown in the catalogues, web sites or any other presentation is available for this kind of sale.
If once an order is made and the product is not available, you will be informed as soon as possible via email or telephone and this order will be cancelled.

2.4. Contract with Purificación García and acceptance of orders. We do not accept orders until the amount is debited from your bank account.
Once the purchase is confirmed, you will receive an email considered as an acknowledgement of receipt, but it doesn’t mean the acceptance of the order, which depends on our subsequent verification and acceptance.
We will send you an email confirming the acceptance and informing you about the delivery. It is only from that moment on that the contract between you and us is formalized and it is limited to the items listed therein.
2.5. Confirmation and cancellation of orders Before you complete the order on the website, you can check all the details related to it (broken down amounts in every section needed, taxes, delivery costs, selected items, etc…) and make the necessary corrections.
After the confirmation you are not allowed to make any modification or cancellation of orders through the website and you should contact the Customer Service. In that case, the order can only be modified or cancelled if the item did not enter in the stage of issuing from our warehouses.
2.6. Currency, taxes and pricesIn accordance with current legislation, every purchase made through our website is subject to the Spanish value added tax (VAT).
Orders placed from the Canary Islands shall be VAT-free, although delivery charges and import taxes and expenses (IGIC, customs clearance, etc…) are not included in the price and customers shall pay them directly to the logistics operator in charge of the delivery. In the same vein, when these customers return an order they must pay the costs of the product leaving their territory, plus 9,95€ of shipping costs.
We reserve the right to make changes to prices shown on the website without prior notice.
The price of any products shall be the one indicated on our site from time to time, except in cases of obvious error. While we try to ensure that all prices on the website are accurate, errors may occur.
If an error in the price indicated on our website is detected, you will be notified as soon as possible. You can reconfirm or cancel the order (in the case of cancellation, automatic reimbursement of the amount you paid will take place immediately).
We are not obliged to provide the product(s) to you at the incorrect lower price (even after we have sent you the Confirmation Order) if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as an incorrect price.
2.7. Payment method and security Any order placed should be paid immediately after its confirmation. We will only process orders once payment is complete and verified. Payment shall be made by a credit/debit card (issued by an entity domiciled in Europe) or PayPal. The following credit cards are accepted: VISA, MasterCard, AMEX.
The amount of the order will be charged to your credit card, therefore, you shall fill in the number, expiration date and security code CW2 (marked on the back of the card). If your credit card is specially protected you will be asked to enter the relevant security codes. For safety reasons, if you select PayPal as a payment option, once you place the order you are not allowed to make any kind of changes in the shipping address.
This information will not be saved or manipulated by us, but it will be directly transferred to the payment gateway of the relevant banking institution. For added security, we use a Safety E-commerce Authentication Service, this system is established by Visa/Mastercard/Eurocard where the cardholder is authenticated with their Issuing Bank and the store is authenticated with its Acquiring Bank. To ensure confidentiality and integrity of the transactions, these are made using protocol SSL (Secure Socket Layer) with security keys of 128 bits.
Real-time charging will be made through this payment gateway. In case the charge cannot be eventually made, the order will be automatically cancelled.
2.8. Deliveries: deadlines and problems Deliveries will be made by a logistics operator to the address you highlight in the order form within the normal working hours. If nobody is found at the premises by the logistics operator, they will leave a note and customer services will contact you in order to make delivery possible.
The usual delivery time is approximately five to seven business days after the acceptance of the order. This period can be extended due to sales, Christmas season and customs´ procedures or certain conditions such as (for information only) geographic distance, weather conditions, wars, strikes, any government intervention, non-performance by our suppliers, etc… or any other reason ascribable to the logistics operator commissioned with the delivery. We are not responsible for any delay due to aforementioned reasons.
Delivery costs are free for the customer when the purchase price is 75€ or over. If it is less than 75€, the customer shall pay the delivery costs (9.95€).
If, upon delivery, the product is damaged, you must open the package in the presence of the carrier to verify the conditions of the items. If signs of damage are found, you must detail them on the delivery form and contact the customer service. We will repair or replace at no charge damaged or lost items during transport, provided you notify this incident as soon as possible. Please note that orders are weighed for delivery before transport.
Once you receive the product, it shall enter into your property, and therefore, you will be responsible for any damage caused to the product from that moment.
2.9. Return, exchange or refund PolicyIf you buy directly from Spain you may return the item to our stores (except El Corte Inglés, outlets and airports, or you may request that we send a messenger to your home). If you make your purchase from the rest of European countries you may return the item to our main offices. In the latter case, the customer must bear the costs of delivery (giving 5€) to the logistics operator at the time of the pick-up).
In orders placed from the Canary Islands, Ceuta and Melilla, customers shall pay outgoing costs (IGIC, customs clearance, etc…) when they return an order.
We remind you that the deadline for returns is 1 month from the date when the order was placed and that is printed on the purchase receipt.
RETURNING ITEMS VIA THE ONLINE STORE:
You shall access the order you want to return on the website, once you find the order, you shall identify the items you want to return. The website will ask you to enter a reason for the return delivery of each item.
Mark the items to be returned in the purchase receipt you received along with the order.
Items shall be returned in the original packaging delivered by the logistics operator.
Once we have received the returned item, we will verify that it physically corresponds to the return delivery note and also that it is received in good conditions, complete, in its original packaging and that it has not been used. If the examination is satisfactory we will credit the refund for the goods back to the payment card that you used to pay for the goods no later than 1 month from the date that we receive the returned Goods.
Otherwise, we will contact you to send you the product again (delivery transport costs of this additional shipment shall be borne by you).
When the reason for the return is that the product is faulty, you can specify in the website you are returning a faulty item and contact our Customer Service Department (email us at firstname.lastname@example.org or call 902 21 11 10)
Once we have checked that in fact it is a damage, we will contact you to inform you about the two possible options: desist from the order (then we refund all the money you have paid to the same credit card you used to make the purchase plus transport costs) or decide that we replace the product (then we deliver another product in good conditions absolutely free of charge and refund you the returning transport costs)
We do not accept returns of jewelry or used items.
We only exchange sizes, colors or items in our PURIFICACIÓN GARCÍA stores, never via our website. Only the Spanish and Portuguese orders can exchange the items in our PURIFICACIÓN GARCÍA stores. The rest of countries can exchange the items through the website.
2.10. Warranty and information about products Featured products in our website are a carefully selected assortment of our collection. We have taken great care to accurately show the colors and characteristics of our products. Since every computer monitor is calibrated differently, we cannot guarantee that you will precisely appreciate every color.
We are working to offer our clients the most accurate and reliable information listed on the website (names, qualities of the products, photos, etc…), but we are not responsible for potential errors that might exist. Images and descriptions are shown for information only. In this respect, we can correct any error or omission on the website and shall not be held responsible for the consequences of such corrections.
