GENERAL MATTERS

These terms and conditions of purchase are applicable to all sales of products of the Purificación García brand made through the website www.purificaciongarcia.com ("Website") of Sociedad Textil Lonia Ltd. ("STL").

STL is a company with registered office at Quadrant House - Floor 6, 4 Thomas More Square, London E1W 1YW, telephone +34 988 519 444 and email contact@stlonia.com.

By placing an order for products, you agree to be bound by these terms and conditions. Any personal information you provide through the Website from which you can be identified is stored securely and confidentially, and is processed fairly and lawfully in accordance with our Privacy & Cookies Policy.

By placing an order, you confirm that you are over 18 years of age and have legal capacity to enter into legally binding agreements.

Orders placed on this Website are intended for domestic and private use only. You must not use this Website to purchase products for resale or commercial use.

Please read these terms carefully before you submit your order. These terms indicate who we are, how products will be supplied, how the contract may be changed or modified, what to do if there is a problem and other important information.

We reserve the right to update or amend these terms and conditions of purchase where we consider appropriate and, accordingly, what should be consulted before making a purchase from the Website.

AVAILABILITY

All products on the Website are subject to availability. If an ordered product is out of stock or it is impossible for us to supply it, we will contact you and refund any amount you may have paid to purchase that product.

WARRANTIES

If you enter into an agreement with us, we offer a contractual warranty on the products sold on the Website.

We will endeavour to offer precise and reliable information on the Website about products for sale (including product names, photographs, composition and attributes, etc.).

PURCHASE PROCEDURE

Please select the type and quantity of products you wish to purchase from the Website (the default will be one unit) and click Add to Cart.

Review My Cart making sure all specifications fit your requirements, then click Proceed to Checkout.

If it is the first time that you have accessed the Website and you wish to register, you may do so by entering your email address and a password. You must keep your password confidential as it allows access to your account. To continue setting up an account you will need to enter your personal details, billing address and delivery address (if different).

If you are a registered user with an active account, please enter your email address and password to log in to your account.

You will then be directed to the shipping confirmation page to select delivery options and confirm a delivery address. You will then proceed to the secure payment page to select the payment type and complete your order.

ORDER ACCEPTANCE

After placing your order, you will receive an automated acknowledgement. Please note that this does not mean that your order has been accepted.

Our acceptance of your order will take place when it is dispatched, at which point a contract will come into existence between the User and STL.

A number will be assigned to your order of which you will be informed upon acceptance. The contract to sell products to you only relates to those products listed in the confirmation email.

If we are unable to accept your order, we will inform you and refund any quantity we may have charged, this might be because a product is out of stock, because of unexpected limitations on our resources for which we could not reasonably plan, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

ORDER CONFIRMATION AND CANCELLATION

Before completing the order, the User may review all the relevant details and products included so that, if considered necessary, they may be modified, added to or eliminated.

Once the order has been formalised by your confirmation, it will not be possible to modify or cancel the order through the Website and, therefore, you will have to contact the Customer Service Department ("CSD") directly (see clause 10 below). Once you have contacted the CSD, provided that the order has not entered the shipping process and been dispatched from our central offices, it will be possible to change or cancel any issue relating to the order.

DELIVERIES

When placing an order, Users can receive it at an address of their choice, except P.O. boxes. Shipping addresses must be located in the same country of the purchase.

Our delivery period is approximately between 2 and 7 working days from the order confirmation. This period may increase at certain times or due to other circumstances beyond our control and, therefore, we are not responsible for any delays that may arise for any of the aforementioned reasons or for reasons directly attributable to third parties unrelated to us.

We will keep you informed regarding the progress of your order by email or text message using the contact details you supply.

Delivery costs are £7,95 regardless the amount of the order.

If when opening the package, the User observes that any of the items are damaged, the damaged articles should be detailed in the delivery note and they should contact the CSD. In such cases, STL will repair or replace, at no cost, any article lost during transport or that has suffered any type of damage during the delivery process, provided that the User reports the incident within 24 hours of receiving the order.

Once the order has been delivered, any damage that may be caused henceforth will be your responsibility. Any risks relating to the purchased product will be assumed by you from the time of delivery.

You will acquire ownership of the products once we have received payment in full, and the purchased products have been delivered. If there is a problem with your order, please contact our Customer Service Department using the contact details provided below.

In the case of orders made in periods of high demand, the estimated delivery time cannot be guaranteed. STL shall not be liable for any failure to meet these delivery dates.

POLICY FOR THE RETURN, EXCHANGE AND REFUND OF PRODUCTS

RETURNS

Returns at Purificación García are free of charge.

You may return your online purchase on the Website by requesting to have it picked up at home.

Returns can be requested up to 30 calendar days from the order confirmation.

You must use the original shipping packaging when returning articles, Purificación García boxes and envelopes included. This way, the goods will arrive in perfect condition.

Returned items must be new, in perfect condition and with original labelling. Footwear without the original packaging will not be accepted as both are considered part of the product.

We do not accept returns of personalised items or those with alterations.

If the order includes a gift associated to any item and a refund is made over that item, the gift needs to be returned as part of the order to proceed with the return.

Returns that do not comply with any of the conditions specified above will not be accepted.

Returns using the Website

The User can access the order containing the item(s) to be returned through "My Account" on the website. Once identified, the User must select the item(s) vain the delivery note they received together with the order and choose a collection address to be provided to the courier.

The article(s) should be returned in the original packaging in which the order was sent and the return will be processed free of charge.

Once the return has been received by STL, it will verify the returned item or items to check that they correspond to those indicated in the return receipt and that they were received in perfect condition.

If the verification is satisfactory STL will refund the money paid by the User for the returned article(s) using the same payment method used by the User for placing the order, within fourteen (14) days of notification of withdrawal.

RETURNS OF DEFECTIVE PRODUCTS

If you wish to return a product because it is faulty, flawed or because it is not as described, you may do so using the procedure described above.

LEGAL RIGHT TO CANCEL YOUR CONTRACT WITH US

In general, if Users enter into the agreement as consumers or users they are entitled to withdraw from the agreement within (14) calendar days.

This period will expire after fourteen (14) calendar days from the date on which the ordered article was delivered to the User.

To exercise his/her right to withdrawal, the User must send a notification to STL at the following postal address: Parque Empresarial Pereiro de Aguiar s/n, 32792 Ourense or by email to lopd@purificaciongarcia.com, in which they communicate unequivocally their decision to withdraw from the agreement between the User and STL.

The user must comply with all the conditions of purchase and return expressed in this document, and consequently, to exercise the right to withdraw, the articles must comply with the requirements mentioned in the POLICY FOR THE RETURN, EXCHANGE AND REFUND OF ORDERS.

PAYMENT METHODS AND PRICE

Orders must be paid as soon as they are confirmed. Only orders for which payment has been verified and completed will be processed.

The price of the product (which includes VAT) will be the price indicated on the Website when placing your order. Prices of the products shown on the Website may be changed without such changes affecting orders in progress when the change was made.

We will attempt to ensure that the price of the product advised to you is correct. If the product's correct price at your order date is higher than the price stated to you, we will contact you for further instructions before accepting your order. If we accept and process an order where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

You may pay for orders by credit or debit card (Visa / MasterCard / AMEX) or using PayPal.

For security reasons, if you choose to pay via PayPal, you may not change the delivery address once the order has been placed.

Your payment details will not be stored or processed by us but will be directly registered by the payment gateway of the financial institution chosen by you to make the payment. For greater security, when payment is made the Website has a Secure Ecommerce Authentication Service, a system established by Visa/MasterCard/Eurocard, whereby Customers are authenticated by their purchasing bank.

To protect the confidentiality and integrity of transactions, our checkout procedure involves SSL (Secure Socket Layer) protocol and 128-byte security keys.

The amount of the order will be charged in real time using the chosen payment method and if the charge is cancelled for any reason and the transaction is not completed, the order will be automatically cancelled.

OTHER IMPORTANT TERMS

This contract is between the User and STL. No other person shall have any rights to enforce any of its terms. Neither party will require the agreement of any other person in order to end the contract or make any changes therein.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

These terms and conditions shall be subject to the laws of England [and Wales], and the courts of England [and Wales] shall have exclusive jurisdiction over all claims or disputes arising out of, or in relation to, these terms and conditions.

FOR WHAT PURPOSES DO WE TREAT YOUR PERSONAL DATA? HOW DO WE LEGITIMIZE THE PROCESSING OF YOUR DATA?

MANAGEMENT OF YOUR BUSINESS RELATIONSHIP WITH STL

Your personal data will be treated in order to develop, control, manage and maintain the contractual relationship established on making purchases in stores managed by STL where necessary.

Said treatment for the purposes indicated is legitimized by the execution of the existing contractual relationship between you and STL. The obtaining of your data for this purpose is mandatory in order to enable STL to establish and manage your contractual relationship.

MANAGEMENT OF PROFILE REGISTRATION AND CANCELLATION IN THE SHARED DATABASE

Your personal data will be processed for your registration and entry into the customer database managed by STL. When necessary, and exclusively for the management of the contractual relationship, STL will communicate the identifying data that you provide us in order to be able to manage your relationship as a customer.

Said treatment for the purposes indicated is legitimized by the execution of the existing contractual relationship between you and STL. The obtaining of your data for this purpose is mandatory in order to enable STL to establish and manage your contractual relationship.

PROCESSING OF YOUR DATA FOR COMMERCIAL PURPOSES BY STL

Your personal data will be processed by STL for the sending of commercial information related to own products linked to and marketed by STL, in addition to opinion surveys. Said information to be sent by any means, including electronic, commercial communications, sending of bulletins and personalized offers. Similarly, your data may be used for profiling purposes in order to send personalized commercial actions and / or oriented to your preferences.

Said treatment for the purposes indicated is legitimized by the application of legislation that foresees said treatment and by having obtained STL consent to that effect.

For those cases legally provided for under article 21.2 of Law 34/2002, of July 11, concerning services of the information society and electronic commerce, as well as by article 16 of the Electronic Privacy Regulation 2017/0003 (e-privacy) of the European Union, STL will be entitled to send commercial communications electronically as long as the content thereof is related to products and / or services similar to those offered in the context of your relationship with STL.

You may, at any time, revoke your consent for the sending of commercial communications of STL products and services. You may refuse such procedure both at the time of data collection and on receipt of each commercial communication sent by STL.

Similarly, STL may use your data in legitimate interest to better meet your expectations and increase your level of satisfaction as a client in cases where legislation permits, provided that these legitimate interests respect your right to personal data protection, honor and personal and family privacy. DATA TRANSFER STL GROUP AND FRANCHISEES

In order to manage the relationship with you as a customer, STL may communicate to those companies that use the STL customer database any identification data that you provide us by filling in the card or via the website in order to verify your identity, as well as to manage all purchases and operations you make in the stores of Purificación García. With this in mind, your data will be included in a centralized database that can be accessed by both STL franchisees and other STL Group companies. In no case will your personal data be communicated to other entities that do not belong to the STL Group or to STL franchisees, without your prior consent.

Said treatment for the purposes indicated is legitimized according to the existence of a legitimate interest for STL. As a result of the use of a centralized customer database, for administrative, operational and logistics purposes, STL may communicate data to all STL's dependent entities with which it shares access to said database with the sole purpose of being able to improve the logistics, administration and your personal management needs by being able to centralize all the purchases you make. This centralization does not entail any detriment to you, on the contrary, it will speed up any order or process, thereby avoiding delays.

The obtaining of your data for this purpose is mandatory in order to enable STL to establish and manage your contractual relationship.

INTERNATIONAL DATA TRANSFERS TO THE STL GROUP

In order to manage the relationship with you as a customer, STL may communicate to those companies that use the STL customer database any identification data that you provide us in order to verify your identity, as well as to manage all purchases and operations you make in the stores of Purificación García. With this in mind, your data will be included in a centralized database that can be accessed by both STL franchisees and other STL Group companies that may be located in countries that do not offer a protection level comparable to European standards. In no case will your personal data be communicated to other entities that do not belong to the STL Group or to STL franchisees, without your prior consent.

Said treatment for the purposes indicated is legitimized by the adoption of adequate guarantees by STL. For these purposes, these international data transfers will be covered by the implementation of adequate guarantees through the signing of a contract to that effect based on the Standard Contractual Clauses for data protection adopted by the European Commission. The obtaining of your data for this purpose is mandatory in order to enable STL to establish and manage your contractual relationship.

FROM WHERE DO WE GET YOUR DATA?

The personal data processed by STL has been provided directly by you by completing the forms provided for that purpose by STL.

HOW LONG WILL WE KEEP YOUR DATA?

STL will keep your data during the validity of your contractual relationship with STL and once expired during the prescription period of the actions that may arise from the relationship maintained.

For merely illustrative purposes, articles 1962-1972 of the Civil Code set deadlines for the prescription of actions that may go from one to thirty years, depending on the type of action to be exercised.

TO WHOM DO WE GIVE YOUR DATA?

Your data will be transferred to the different entities that form part of the STL Group (subsidiaries and franchisees) and that have access to the customer database, to which your personal data will be sent as a customer of STL products, for the handling of the following:

  • Collection and payment derived from the relationship with you.
  • Registration and removal of customer profiles in the STL database.

Similarly, STL may outsource certain functions in order to improve the quality of service and/or for internal administrative purposes, and to this effect it will collaborate with Data Processors, always within the context of a Data Processing Agreement (DPA) that offers adequate guarantees.

WHAT ARE YOUR RIGHTS WHEN YOU PROVIDE US WITH YOUR INFORMATION AND HOW CAN YOU EXERCISE THEM?

As long as STL processes your personal data through automated means based on your consent or an agreement, you have the right to obtain a copy of your data in a structured, commonly used and machine-readable format transferred to your name or to a third party. It will only include the personal information that you have given us.

RIGHT OF RECTIFICATION:

You have the right to request the rectification of your personal data if it is inaccurate, including the right to complete incomplete data. Remember that in your User Area you can modify your personal data.

RIGHT OF SUPPRESSION:

You have the right to obtain without undue delay the suppression of any personal data processed by STL at any time, except in those situations that the law considers an exception, such as compliance with a legal obligation.

RIGHT TO OPPOSE THE PROCESSING OF DATA ON THE BASIS OF LEGITIMATE INTEREST:

You have the right to object to the processing of your personal data based on the legitimate interest of STL. We will not be able to continue processing personal data unless we can attest compelling legitimate reasons for said processing that prevail over your interests, rights and freedoms, or for the formulation, exercise or defense of claims.

RIGHT TO OPPOSE DIRECT MARKETING:

You have the right to oppose direct marketing, including profile analysis made for direct marketing purposes.

RIGHT TO RESTRICTION:

You have the right to request that STL limit the processing of your personal data in the following circumstances:

  • If you object to the processing of your data based on the legitimate interest of STL, STL must limit any processing of such data pending the verification of legitimate interest.
